Information about Sparly

These general terms and conditions ("Terms") apply to all services provided by Sparly AB (559249-7589) ("Sparly", "we", "our" or "us") to our members ("you"). Sparly develops and provides a mobile application “Sparly” available on the App Store and Google Play. The purpose of Sparly is to build tiny habits with a big impact on your money. Acceptance of the Terms

By registering an Account and using the Service, you accept the Terms and become a Sparly Member. If you do not agree to the Terms, you may not create an Account and use the Service.

To access the Service, you must be 18 or older. We set an age limit to comply with the Marketing Act in Sweden.

Definitions

"The App" refers to our mobile application available via mobile phone and concerning the Service.
"Functions" refers to the Website, the App, your Account and the Service together.
"Website" refers to our website (https://sparly.co/) concerning the Service.
"Account" refers to the account you register and create via the App.
"Contact information" refers to the information provided above.
"Privacy Policy" refers to our Privacy Policy (https://www.sparly.co/policy) which describes how we process personal data.
"The Service" refers to the services described in the "Service" section below and made available through the Website, and the App, together with associated products, services and information that we provide to you.

The Service

The Service

  • Sparly provides a free mobile application to increase financial literacy through tiny money habits. We call those “Sparly Habs” - habits to build financial skills: learn to save, invest, pay-off debt, reflect and raise awareness about your money situation, etc. We provide personalized Habs by analyzing your purchasing behavior, your financial goals and level of financial knowledge.
  • You need to link your bank accounts to the mobile app to use the service. Sparly collaborates with Tink AB (corporate identity number 556898-2192, hereinafter “Tink”), an API platform that retrieves and aggregates your transactions from banks and account management institutes. You consent to Tink to collect transaction data from your banks and other account management institutions and share this data with Sparly. In connection with the commencement of the use of the Service, you enter into a separate agreement with Tink by approving Tink's General Terms of Use and Tink's Privacy Policy. If you have added one or more joint payment accounts, it is your responsibility to obtain approval from all other account holders. You sign with BankID to give express consent for collecting and sharing your data from your banks.
  • We do not check the accuracy of the personal account information and personal information you provide, and we trust you and your personal account providers to ensure that the personal account information and personal information you provide to us is up to date and accurate.
  • Transactions from added payment accounts may be updated automatically in the Sparly app up to four times a day or more often. Automatic updates take place for up to 90 days, after which you must provide new consent in the app.

  • To access the Service, you need an account. The account is created automatically and connected to your sim card number when you click the button “Enter”. Once an Account has been created, the Service is available and ready for use in accordance with the instructions on the Website and the App.
  • Your agreement with Sparly in accordance with these Terms runs until further notice. You may not allow anyone to access the Service on your behalf. You must treat the confidential information you provide as part of our security procedures, and you must not disclose it to any third party.
  • You can at any time decide to terminate your account and delete your data. You do this by deleting an account in the app under the "Settings" tab and selecting “Delete my account”. We will delete all personal identifiable data about you. We manage feedback and support details in a different system - to delete these send a separate request by email.

Swedish law shall apply to these Terms and our legal relationship in general.

Modification of the Terms

Modification of the Terms

We reserve the right to change the Terms at any time. We will notify you via e-mail or the App of such changes that are not insignificant and which will affect you. We will inform you that it is important to object if you do not approve of the changes. If we do not receive such an objection within thirty (30) days of the changes being notified, we will assume that you accept them. We will also assume that you approve the changes in cases where you enter into an agreement with us, for example, by continuing to use the Service after the new terms have come into force. The latest version of the Terms is always available on the Website.

We are responsible, where applicable, for us:

  • Performing the Service in a professional manner
  • Ensures that the Service is not performed in a manner that is contrary to the Marketing Act.

Sparly has a liability under the law for damage that Sparly has caused you due to a breach of the Agreement. However, Sparly shall not be liable for indirect damage or other consequential damage to you, unless the Company has acted with gross negligence. The Company's liability is further limited to damages that have been caused by the negligence of the Company, and which have no connection with a breach of contract or actions on your part. Sparly is not responsible for errors caused by you, errors in your equipment, or errors in equipment that does not belong to Sparly or for third-party websites, software, services, or content.

Sparly intends all information in the Services to be accurate and up to date. We are not financial advisors, and the service is not intended to provide financial advice. Your financial situation is unique. We make no warranties or guarantees of any kind, whether the service is suitable for you. Sparly disclaims all responsibility for your financial decisions based on the use of the app and for your decision based on the use of services, functions or information provided by third parties, such as Sparly's partners and third-party providers.

Errors and delays beyond our control (force majeure)

We are not responsible for delays and errors beyond our control. If our suppliers are delayed due to an event beyond our control, we will notify you as soon as possible and take steps to minimize the damage caused by the delay. If we have fulfilled this, we are not responsible for errors and delays caused by the event, but if there is a risk that a material error or delay occurs, you can contact us to terminate the agreement.
